Key answers before visiting a notary office in Barcelona
Notary fees are regulated by the central Government, which means that a notary in Barcelona charges exactly the same as one in any other city for the same basic document. However, the final invoice cost (the "bill") varies according to the number of pages in the document, the authorised copies you request and the additional procedures you delegate to them, such as electronic filing with the Registre de la Propietat de Barcelona. By law, all notary offices can apply a maximum discount of 10%, but none can compete by aggressively lowering prices.
When you buy a property in districts like Gràcia or Poblenou and apply for financing, the notary fulfills a mandatory and free protection function before signing. You must visit the chosen Barcelona notary office at least one day before signing the deed to complete the so-called transparency test. In this private meeting, the notary will explain the loan clauses, verify that the bank complies with the law and resolve your doubts about the particularities of the Barcelona property market, ensuring that you fully understand what you are going to sign.
This is the main reason why you need a notary in Catalunya. Unlike the common civil code of the rest of Spain, in Barcelona the Codi Civil de Catalunya applies, which introduces crucial differences:
- The Catalan statutory share is only one quarter (25%) of the inheritance to be distributed among children, compared to one third (33.3%) under the common code.
- It allows for the drafting of so-called succession pacts, which are inheritances during one's lifetime that cannot be unilaterally revoked, a widely used instrument to guarantee the continuity of family businesses in the Catalan business fabric.
- It regulates the figure of the "heir" in a much stricter manner, making their appointment mandatory for the will to be valid.
In Barcelona's historic centre (such as Ciutat Vella or the Gothic Quarter) it is very common to find properties whose actual dimensions do not match those appearing in old deeds or in the Land Registry. If you are going to sell or renovate a property and detect this error, the notary must process a deed of acknowledgement for excess area. This procedure requires the notary to notify the neighbouring owners of the building, verify the physical reality through a technical report and coordinate the rectification directly with the Catastro de Barcelona and the Property Registry to unify the data.
To incorporate a company (S.L. or S.A.) in the city, the notary does not simply draft the deed of incorporation. Today, Barcelona notary offices are electronically connected through the ANCERT platform (Notarial Certification Agency). From the notary office itself, the negative certificate for the company name is requested, the provisional tax ID is processed with the Agencia Tributaria and the authorised electronic copy is sent directly to the Registro Mercantil de Barcelona (located on calle Salvador Espriu). This allows your company to be incorporated and registered within just 24 to 48 hours.
